Collective Commentary about the New Package Travel Directive

758 COLLECTIVE COMMENTARY ABOUT THE NEW PACKAGE TRAVEL DIRECTIVE autonomy. The Danish Package Travel Act does not encompass any of the options for better protection given in the Directive. So far, no indication of wrongful implementation of the new Directive into Danish law has been observed. The Directive is very much in line with the former Danish Package Travel Act. The finishing remark is provided by Professor Kim Østergaard and Senior Legal Manager Kenneth Melancton Nielsen: “In relation to the law of obligation, the Directive still upholds a state of fragmented legislation in the area of travel services. Thus, despite the fact that the Directive in general provides a better legal position for the traveller, applicable law still needs to be derived from implemented EU-legislation, international conventions, special legislation and principles of law of obligations … as a consequence of the services’ unique character.” 23 . 23 Translated from ØSTERGAARD, K. AND MELANCTON NIELSEN, K., Pakkerejsereguleringen – Det nye direktiv (‘Package travel legislation – the new Directive’), Erhvervsjuridisk Tidskrift , 2016, p. 169.
