The law also bans the creation of new holiday property on protected rustic land (although those already there before the law came into effect may continue to operate). 12. Where the marketing of a property is done by natural persons who own the property and it is their main home for a maximum period of 60 days per year, the marketing of tourist stays may be undertaken according to the permanent home tenancy method. In exceptional circumstances, this method enables the home to be shared by permanent residents and users, as long as this is clearly stated in all advertising and the total number of people does not exceed the number of places stated in the occupancy certificate. 13. Homes marketed to tourists must have one bathroom for every four places. c) Services in the holiday property: Properties marketed to tourists must provide users with a set of tourist services, such as periodic cleaning of the property, the provision of bed linen, towels and general household wares, maintenance of the facilities and 24-hour telephone support for users. d) Marketing procedure: As with all tourist activities, in order to operate a tourism business companies and operators must present, before the activity begins, the corresponding statement of compliance for tourism business (DRIAT) to the island Register of Tourism Companies, Activities and Establishments. If the property does not have a tourist registration number, the incorporation of the initial registration number when the DRIAT was presented in the Registry shall be admitted. Where the property already has a tourist registration number, all advertising must include said number. Failure to do so may be deemed a serious infraction for owners or a critical infraction for tourism marketing channels. In short, we can see how the regulation of holiday properties in the Balearic Islands is much stricter than in other regions given the many requirements to be met in order to undertake this activity.
