Collective Commentary about the New Package Travel Directive
ARTICLE 11 | CHIARA TINCANI 277 would have done better to follow this example. Instead, for many States the Directive transposition was a mere transcription which caused different systems and provisions to overlap and interfere one with each other instead of being integrated with the respective National laws and with private law in general. It is indeed not by chance that the Luxembourg Chamber of Commerce 39 has criticised this method and the law draft that it generated; such a criticism is born out of common sense since national laws use the same EU terms and make no attempt to adapt them and connect them to the respective national law systems. 39 See the avis de la Chambre du commerce concerning the projet de loi n. 7136 relatif aux voyages à forfait et aux légations de voyage liées , of 13 July 2017, according to which, with regard to significant modifications, it would have been better if, in the provision, it had been clarified that these were intended to mean that “ causent aux voyageurs des désagréments importants ou des frais supplémentaires ou les obligent à prendre de nouvelles dispositions en termes de transport ou d’hébergement ” .
