JAVIER MELGOSA ARCOS 515 contracts established in the legislation on package travel, including over- -contracting (art. 71, section 13). b) Aragón .Themodified text of the AragonTourismLaw has not specific reference to package travel and classifies as a serious offence “the formalization of contracts with tourists against what is prescribed in the legislation” (art. 84 section 5). c) Balearics . Law 8/2012 of 19 July 2012 on tourism in the Balearic Islands classifies as a minor infringement the breach of the provisions regarding the booking and cancellation regime and, as serious infractions: t) the breach of the offer on package travel included in the brochure, whenever it causes damage to customers; u) advertising that may produce deception about the essential elements, benefits or services that make up the tour package or combined services appearing in catalogs, brochures, advertising or specific offers of companies and tourism activities; and v) failure to comply with the regime provided in the regulations on package travel in the event of non-confirmation of the booking, modification of the essential elements or the contract resolution (art. 105). d) Castile and Léon . Law 14/2010 of 9 December 2010 on tourism of Castile and León, is the regulation with more references to package travel in the classification of sanctions. In particular, it includes four types of minor offences (art. 81): m) The delay in compliance with the refund of the price in case of termination of the package travel contract; n) The breach of the obligation of proof or written form required by the regulations on package travel; ñ) The error or inaccuracy in the information or in the content of the documentation required in the regulations on package travel, when no harm is caused to customers; and, o) The breach of the offer on the package travel included in the information brochure, provided that no harm is caused to customers . The section on serious infringements (art. 82) includes five types: ñ) The breach of the offer on the package travel included in the information brochure, whenever damage is caused to customers; o) The error, inaccuracy, absence or falsification of the information or in the content of the required documentation in the regulation on package travel, when damage is caused to customers; p) Review the prices of the package travel contract outside the assumptions foreseen in its regulatory standard; q) Breach of the regime established in the regulations governing package travel in case of non-confirmation of the booking, modification of the essential elements or contract resolution and, r) Non- -assumption of the solutions provided in the regulations on package travel in case of not providing the contracted services after the trip departure date.
