With regard to this Directive, the legislator considers the transmission of such documents to be justified”. In the article 18, relating to “Mutual recognition of insolvency protection and administrative cooperation” on the transposition of the article 17 in the relevant national legislation states that: “1. Member States shall recognise as meeting the requirements of their national measures transposing Article 17 any insolvency protection an organiser provides under such measures of the Member State of his establishment”. Article 23.2 establishes the “imperative nature of the Directive” by specifying that: “2. Travellers may not waive the rights conferred on them by the national measures transposing this Directive”. In this paper we analyze the current situation of the EU Member States in relation to the transposition of the indicated Directive, taking into account the date of last update 10 . II. NATIONAL TRANSPOSITION MEASURES FOR THE PACKAGE TRAVEL DIRECTIVE 1. Austria The following regulation has been approved 11 : Federal Act 50: Package Travel Act Act [Pauschalreisegesetz – PRG] and amendment of the Consumer Protection Act [Konsumentenschutzgesetz], the Distance Selling and External Business Act [Fern- und Auswärtsgeschäfte-Gesetz] and the Consumer Authorities Cooperation Act [Verbraucherbehörden Kooperationsgesetz] (NR: GP XXV RV 1513 AB 1533 p. 173. BR: AB 9768 S. 866.) [CELEX-No: 32015L2302] 12 .
