Regulation (EC) No. 1371/2007 of the European Parliament on rail passengers’ rights and obligations aims to define the rights and obligations of the rail services’ passengers and make this mean of transport more attractive. This Regulation applies to railway undertakings and transport services which are licensed under Directive 95/18/EC, not applying to unlicensed railway undertakings and transport services. Travellers have the right to be provided of a transport contract, information on the applicable conditions (rates, duration, delays, etc.) and tickets sold at ticket offices, automatic vending machines or via the Internet and telephone. The Regulation extends the rights of passengers to receive compensation due to delays or cancellations. Users may request a minimum compensation equivalent to 25% of the ticket price for a delay of 60 to 119 minutes; 50% of the ticket price for a delay of 120 minutes or more. h) Schengen Border Code. Finally, the provisions of the Schengen acquis shall be taken into account too: Regulation (EU) 2016/399 of the European Parliament and of the Council, of 9 March 2016, on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code) and Regulation (EC) No. 810/2009 of the European Parliament and of the Council, of 13 July 2009, establishing a Community Code on Visas (Visa Code). Consumer protection as a tourist had its greatest exponent in Directive 90/314 / EEC of 13 June 1990 on package travel, package holidays and package tours (OJ 23.06.1990) but we can not forget other provisions applicable to different situations generated in the broad tourism and travel context, such as Regulation (EC) No. 261/2004 of the European Parliament and of the Council of 11 February 2004, establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights (repealing Regulation (EEC) No 295/91) or Directive 2008/122 / EC of the European Parliament and of the Council of 14 January 2009 on the protection of consumers in respect of certain aspects of contracts timeshare real estate use tourism, acquisition of holiday products, long lasting, resale and exchange contracts (Repeals Directive 94/47 / EC of the European Parliament and of the Council of 26 October 1994 on the protection of purchasers in respect to certain aspects of contracts for the purchase of a right to use immovable properties on a timeshare).
