974 COLLECTIVE COMMENTARY ABOUT THE NEW PACKAGE TRAVEL DIRECTIVE 2) despite the fact that whether separate contracts are entered with different suppliers of tourism services, tourism services shall meet at least one of the following conditions: a) the tourist is able to select the service and the service can be acquired in a single point of sale before the traveller agrees to pay; b) services are offered, sold or charged at an inclusive or total price; c) such services are advertised or sold under the term “organized tourist journey”, “package” or under a similar term; d) travel services combined after the conclusion of a contract by which a trader entitles a traveller to choose among a selection of different types of travel services; e) a combination of travel services acquired from different tourism service providers while using linked online system should be considered to be a package where the traveller’s name, payment details and e-mail address are transmitted between the traders and where another contract is concluded at the latest 24 hours after the booking of the first travel service is confirmed. In order to implement the Directive 2015/2302 of the European Parliament and of the Council of 25 November 2015 on package travel and linked travel arrangements, the Director of the State Tourism Department under the Ministry of Economy determined standard terms and conditions of the contract regarding organized tourist journey by the 7 August 2018Order No. V-132. It is determined that the tour organiser or travel agent is responsible for including standard terms and conditions of the contract regarding organized travel into travel contract in that case if the contract of organized travel is concluded by the travel agent. In addition, in this order of the Director of the State Tourism Department the major parts of the contract are presented in details and discussed: parties of the contract, object of the contract, price of the journey, order and terms of the payment, obligations of travel organiser, obligations of tourist(s), termination of the contract, refusal, conditions for amendments of the contract and travel price, the change of the parties of the contract, responsibility of travel organiser, final provisions.
