Collective Commentary about the New Package Travel Directive

LITHUANIA | JOLANTA VILKEVIČIŪTĖ 975 select tourism services separately and to pay separately for them during one visit (form No. 2); standard form for provision of information, when the seller of travel package services intentionally helps the tourist to acquire at least one additional tourism service from the other provider of tourism services and the additional contract is concluded during the next 24 hours after the confirmation of the first tourism service reservation (form No. 3). Under Article 12 of the Law on Tourism of the Republic of Lithuania, the ensurement of fulfillment of obligations of the travel organiser (established in Lithuania) by valid liability-related insurance and (or) financial guarantee provided by the financial institution is determined. Article 13 of the same Law identifies that the amount of the ensurement of fulfillment of obligations of the travel organiser shall be not lesser than 3 000 Euros.The amount of the ensurement of fulfillment of obligations of the outbound tourism has to be the following: 1) 50 000 EUR not organizing nonscheduled flights; 2) 200 000 EUR organizing nonscheduled flights; 3) 7 percentage of income of the last ended four quarters for the sales of organized travels under all concluded organized travel contracts; 4) The amount of all received income of travel organiser under all concluded but not implemented yet travel contracts. In that case, if the travel organiser provides local tourism and outbound tourism services, the amount of the ensurement of fulfillment of obligations is calculated while following the Part 2 of Article 13 (the amount of the ensurement of fulfillment of obligations of travel organiser has to be the maximum amount of the amounts mentioned above). It should be noted that the procedure of the ensurement of fulfillment of obligations of travel organiser is described in the procedure of the insurance of fulfillment of obligations of travel organiser and seller of tourism services package resolved by 12 September 2018 Resolution No. 924 of the Government of the Republic of Lithuania The fulfillment of obligations of the travel organiser established in the Republic of Lithuania is granted to all tourists, who acquired organized travel, without taking into account their place of residence, the initial departure place or place, where the organized travel was acquired, and in which member state the institution responsible for the insurance of fulfillment of obligations is located (Article 16, Law on Tourism of the Republic of Lithuania).
