44 SUSTAINABLE TOURISM LAW In fact, it is necessary to justify the transition from the old definition of “Touristic Legislation”, used a few decades ago, to the most modern “Tourism Law” diction. The term “Touristic legislation” has now a reductive and archaic flavour. It simply indicates the non-systematic set of rules that may affect tourism in its various forms. The shift to the “Tourism Law” diction means that the set – even if non-systematic – of tourism-related norms is taking a unitary line. Legal phenomena exist on the outskirts of institutions, and those institutions connect, interacting with each other. It may be of relevance to report here some definitions. The United Nations’ World Tourism Organization (UNWTO) refers to the necessity “ to provide a regulatory framework for the proper development and management of tourism activities ”. Vietnam legislation refers how “ This Law provides for tourism resources and activities; rights and obligations of tourists, organizations and individuals doing tourism business and other organizations and individuals engaged in tourism-related activities ” 20 . An interesting definition of Tourism Law is given by the Supreme Court of Mexico, that defines tourism as follows: “ Is that originates in legal rules, principles, judicial resolutions and law, in the areas of public, private and social, that are intended to regulate relations of tourism activities on host and receiving regions and transit between them ” 21 . Without presuming to have found a definitive result, we can say that nowadays Tourism Law is the normative background through which tourism is realized and interacts with other disciplines. II. THE EVOLUTION OF TOURISM. SHORT HISTORY OF TOURISM AND TOURISM LAW IN ITALY Travellers in the Italian landscape Travel, which is the mother of all tourist interests, has always been part of Italian history and culture.
