Also, the tour operator must reimburse the amounts collected for services not provided by the trader at the destination due to the insolvency of the tour operator that has allowed the preparation of the travel. It is not foreseen, however, the return of the previously liquidated amounts if the services are not provided due to the insolvency of the employer who must supply them. Finally, dealing with the repatriation of the traveller has also been anticipated, if the operator that allows the assembly of the linked travel is the one who is obliged to provide the transport service. Obviously, all the above will be effective if Spain does not go a step further in transposing this Directive and does not decide, in accordance with its national legislation, to protect in the same way the different travel combinations, regardless of whether it is a package travel or a dynamic package (Indicated in 21 of the Directive 2015/2302). Now, if we look back and review the position of the Spanish legislator and the jurisprudence on the package travel contract, it does not seem that such solution is easy to adopt. In our opinion, it is not the most appropriate option either, among other reasons because if this were the definitive option of the Spanish legislation when incorporating the Directive 2015/2302 into domestic law, it would greatly aggravate the responsibility of the intermediaries, imposing a guarantee that is exceptional in the mandated contract.
