Once a legal entity has been established under the chosen legal form, it is necessary to apply for the registration of a food business operator, i.e. the right to perform food management activities and inclusion in the list of Food Handling Entities maintained by the State Food and Veterinary Service. The food business operator is registered for an indefinite period and no state fee is charged. Permits are issued by the territorial departments of the State Food and Veterinary Service. When registering a food handling entity, the territorial department shall specify the specified economic and commercial activities that the food handling entity may engage in. When applying to the State Food and Veterinary Service for registration, food business operators must prove that they comply with the food handling requirements established by legal acts, i.e. must submit the documents specified in the descriptions of the procedure approved by the Director of the State Food and Veterinary Service confirming the right to use the food handling place, including vehicles, as well as documents on infrastructure, equipment, food handling compliance, hygiene, scope of activities and self-control system (Article 4 (1) of the Law on Food of the Republic of Lithuania). The Law on Food of the Republic of Lithuania (2000) establishes the requirements for food placed on the market and its handling, the competence of state institutions and public consumer protection organisations in ensuring food safety, as well as regulates the duties and responsibilities of food handlers and producers and suppliers of food contact products. The provisions of this law are in line with the legal acts of the European Union. The law also contains key concepts related to food handling. Only the food, products and materials in contact with food that meet the safety, quality and handling requirements established in the Law on Food of the Republic of Lithuania and other legal acts must be placed on the market. The safety of a food shall be determined in accordance with the criteria laid down in Article 14 of Regulation (EC) No 178/2002. Whether products and materials in contact with food are safe is determined in accordance with the criteria established in Article 3 (1) of Regulation (EC) No. 1935/2004 (Article 4 of the Law on Food of the Republic of Lithuania).
