11 Another aspect which has recently been legislated upon is the ban of advertisement of sexual tourism. This prohibition is found in the Criminal Code under article 208 AB. Hence, no person could be involved in the organisation of travel arrangement with the purpose of inducing persons under age to prostitution and to instigate with violence persons under age to prostitution or to participate in a pornographic performance. So, in view of the above, where does Maltese Tourism Legislation commence and where does it terminate? In the author’s opinion, Tourism Law cannot be based solely within the confines of the Malta Travel and Tourism Services Act, as it also expands and impinges on other laws, including Criminal Law, Civil Law, Food Safety Law, Consumer Law, Equal Opportunities Law, Health and Safety Legislation, Fire Safety, Road Safety, Marine and other related activities, to mention just a few… This is the reason why Tourism Legislation is so dynamic.
