410 SUSTAINABLE TOURISM LAW Protectionist laws, passed in the 60s and 70s, banned the implementation of several tourist projects in these areas, but they did not prevent their occupation by thousands of irregular dwellings, which make up the slums, and have now consolidated and become definitive. Therefore, the legal protection of sustainable tourism has to go through an urbanization process that is also sustainable, and not only prohibitive. As many people say, a place is not attractive to visitors if it is not attractive for its dwellers. II. BACKGROUND In Brazil, the Estate is responsible for regulating the continuous use of tourist heritage, without losing its attractiveness, as a factor in the sector planning process, aiming to prevent its degradation and preserve it for future generations This was already indicated in Report n.º. 1 of the BrazilianTourismCompany – EMBRATUR, of 04.29.1976, that acted as executor of the National Policy of Tourism: “EMBRATUR has been giving special attention to the areas that, due to the beauty of the landscape, historical importance, or remarkable conditions for the practice of tourism, constitute the national tourism heritage” In the same vein, a preliminary document of the same organ from August 1977 regarding the national policy for tourism set forth among its objectives the preservation of the country’s cultural and natural heritage, as follows: “In an intimate association with the other agencies and entities, private or of public administration, the inventory of assets of natural or cultural value, subject to special protection regime, and having a tourist interest will be organized and maintained. The identification and declaration of the special areas shall aim at promoting tourism development, preservation and enhancement of natural and cultural heritage, and the establishment of rules for the rational use of the land. The places of tourist interest shall be declared so for the purpose of allowing the discipline of their use and occupation, as well as the preservation, protec- tion and adaptation of included assets” (italic by the author).
