252 WINE LAW with little influx of bystanders), so that social distancing measures have been dictated to avoid the spread of COVID-19. In terms of responsibility, as mentioned, article 25 LBRL establishes that public health and road infrastructures are municipal responsibility, with the Town Halls, through municipal ordinances, regulating the consumption of alcohol on public roads in their spatial scope. This, once again, without prejudice to the fact that other administrations of supramunicipal scope are granted jurisdiction titles to regulate this activity. Such is the case of the Autonomous Community of Andalusia, whose regional parliament approved Law 7/2006, of 24 October, on administrative powers regarding certain leisure activities in the open spaces of the municipalities of Andalusia 18 . In its article 3, are listed the specific limitations on alcohol consumption on public roads: a) the permanence and concentration of people who are consuming drinks or carrying out other activities that endanger the peaceful coexistence of citizens outside the areas of the municipal term that the City Council has established as permitted; b) commercial activities for the supply of beverages for consumption in open spaces 19 through orders made by telephone, messaging, telematics or any other means; c) the delivery or dispensing of alcoholic beverages by commercial establishments outside the established hours by law for sale, even when the economic transaction or payment of the amount of the drinks purchased had been carried out within the permitted hours; d) the sale or dispensing of alcoholic beverages by hospitality or entertainment establishments, for consumption outside the establishment and the areas attached to them duly authorised; e) the abandonment or dumping, outside the garbage disposal points, in the open spaces, the containers and remains of beverages and other containers used in the leisure activities described in this law; 18 This Law is protected by competing titles concurrent with the consumption of alcohol on public roads. Not in vain, the Statute of Autonomy for Andalusia, attributes to the Autonomous Community, in its article 13, among others, powers in the field of sports and leisure (31), local regime (3), urban planning (8), promotion and regulation of tourism (17), health and hygiene (21), promotion and promotion of culture in all its manifestations and expressions (26), promotion of activities and services for youth and the elderly (30), shows (32); in article 15(1)(5), environment; and, in article 18, promotion and planning of economic activity [(1)(1)], domestic trade and consumer and user defence [(1)(6)]. 19 Article 1(3) of this Law defines open spaces as any public road, zone or outdoor area of the corresponding municipal term of public or patrimonial domain of Public Administrations.
