THE EVOLUTION OF ROMANIA’S VINE AND WINE LAW 475 existing vineyard, is only made based on the planting/replanting right. Outside the vine-growing areas, it is possible to set up plantations or extend the existing ones up to 0.5 ha only on the basis of a planting/replanting right. The establishment of vineyards in areas larger than 0.5 ha is only done according to a project for the establishment of the vineyard, approved by the territorial units of wine research. Vine plantations established without complying with these provisions are considered illegal and must be cleared by the owners at their own expense. The area planted with vines, on which no technological works are carried out, according to good agricultural and environmental practices, for three years, represents the area of abandoned vines and is thus qualified as a result of the findings made by a special commission, which also orders the highlighting of the abandoned area in the RPV. Deforestation of vineyards with an area of more than 0.1 ha is done by individuals or legal entities only after the submission to the County Agricultural Directorate of a “Declaration of deforestation of vineyards”, the concerned person or entity will then have a replanting right, in an area equivalent to that of the grubbed-up. IV. NATIONAL REGULATORY FRAMEWORK APPLICABLE TO WINE PRODUCTION AND MARKETING IV.1. Definition of Wine and Other Wine Products Grapes are the raw material for several wine products, including grape must, grape juice, grape must other than that which has been partially fermented or whose fermentation has been stopped in other ways than by the addition of alcohol, wines of fresh grapes, including fortified wines or with the addition of alcohol, wine vinegar, wine lees and grape marc. The Methodological Norms for the application of the Law of Vine and Wine (Methodological Norms) 23 contain the legal definitions of wine and other categories of wine products. The technical characteristics that each wine product must have in order to be able to bear the respective name are taken from the Annex VII Part IV of EU Regulation no. 1308/2013, in which they are established for each wine product: wine, new wine still in fermentation, liqueur wine, sparkling wine, quality 23 The Methodological Norms for the application of the Law of Vine and Wine were approved by Romanian Government Decision no. 512 of 20 July 2016.
