19 force the consumer to turn the bottle. What has not been mentioned, however, is the meaning of these terms. While “bottling” means putting the product concerned in containers of a capacity not exceeding 60 litres for subsequent sale, consequently the bottler is the person either carrying out the bottling or having it carried out on his behalf. Quite a different meaning has the producer , who is the person by whom, or on whose behalf, the processing of the grapes, grape musts and wine into sparkling wines, aerated sparkling wine, quality sparkling wine or quality aromatic sparkling wines is carried out. The importer is the person established within the Community who assumes responsibility for bringing into circulation non- Community goods, while the vendor is the person – not covered by the definition of “producer” – purchasing the wines and then putting them into circulation. Another recurring term may be “address”, which refers to the local administrative area and the Member State in which the head office of the bottler, producer, vendor or importer is situated 37 . The name and address of the bottler shall be supplemented either by the words “bottler” or “bottled by” or by terms, whose conditions of use are defined by Member States, where the bottling of wines with PDO or PGI takes place: (i) on the producer’s holding; (ii) on the premises of a producer group; or (iii) in an enterprise located in the demarcated geographical area or the immediate proximity of the demarcated geographical area concerned. In case of contract bottling, the indication of the bottler shall be supplemented by the words “bottled for” or by the words “bottled for (…) by (…)”, when the bottling has been carried out on behalf of a third party. If the bottling takes place in another place than that of the bottler, all such particulars shall be accompanied by a reference to the exact place where the operation took place and, if it is carried out in another Member State, the name of that State. 37 See article 46 of Regulation EU 33/2019 (previously article 56 of Regulation EC 607/2009).
