24 3. Wine Labelling 3.1. Entering into force of the current CMO Pursuant to Regulation (EU) No 1308/2013 42 , marketing standards should apply to enable the market to be easily supplied with products of standardised and satisfactory quality, and, in particular, should relate to technical definitions, classification, presentation, marking and labelling, packaging, production method, conservation, storage, transport, related administrative documents, certification and time limits, restrictions of use and disposal. In order to take into account existing labelling practices, the power to adopt certain acts should be delegated to the Commission in respect of permitting the use of a name of a wine grape variety which contains or consists of a protected designation of origin or a protected geographical indication. The description, designation and presentation of products of the wine sector covered by this Regulation can have significant effects on their marketability. Differences between the Member States’ laws on the labelling of products of the wine sector may impede the smooth functioning of the internal market. Therefore, rules were laid down, taking into account the legitimate interests of consumers and producers, primarily on labelling and presentation. Rules on designations of origin, geographical indications and traditional terms were based on protecting the legitimate interests of consumers and producers and ensuring the smooth operation of the internal market in the products concerned, as well as promoting the production of quality, whilst allowing national quality policy measures. Finally, with the entry into force of Regulation No 1308/2013, a general framework for all labelling and presentation issues of wine products is achieved. Under its Section 3 of Chapter 1, a systematic reading of the labelling issues was finally allowed, with a definition for “ labelling ” as any words, particulars, trademarks, brand name, pictorial matter or symbol placed on any packaging, document, notice, label, ring or collar accompanying or referring to a given product and for “ presentation ” as any information 42 Regulation (EU) No 1308/2013 of the European Parliament and of the Council, of 17 December 2013, establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007.
